Monster Cable drops lawsuit against Monster Mini Golf. Battle "won, but war not over yet." Even though they have dropped the suit, they are still opposing our marks with the USPTO. Thus, that remains an ongoing matter which requires ongoing legal fees (in addition to the $200k we already incurred), time and effort. On the flip side, Monster Cable has offered to license the Monster trademark for $100/mo to each Monster Mini Golf facility (23 total) and will also donate and match the royalty proceeds to the Elf and Seg4Vets charities.

Monster Cable has come out with what looks to be a truly innovative product. We've seen fat cables and flat cables, cables of all colors, finishes, and lengths. We've tested cables, we've reviewed cables, and we've talked about them to no end. But, for the first time, at least since VizionWire went belly-up, we're seeing a truly thin HDMI cable. At only 3.5mm in diameter (the size of the jack on your headphones), it really is significantly thinner than everything else out there. Monster says it is around 65% thinner than normal HDMI cables! Now that's thin!

On Monday, Fanny Wang Headphone Co. appeared in San Francisco Federal Court to argue a motion filed by Monster Cable and Beats Electronics to prevent them from showing their new headphones at CES, a product that would inevitably raise the bar in style and sound against Beats by Dr. Dre. The judge denied the restraining order indicating that there is insufficient evidence that the new headphones infringe on patents and trade dress as alleged by Monster. Fanny Wang successfully argued that the on-ear headphones do not infringe on Monster Cable's design patent due to its distinct ornamental design, also arguing that the functional elements (hinges and slides) are not protected under design patent law.

Clint finds that he’s not “bitter enough” to really replace Tom for any length of time. Clint’s Monster Cable long HDMI cable shootout is finally published at Audioholics. The same week, Monster Cable sues a children’s clothing store. Yeah... it's been an interesting seven days.

It seems ages ago that we reported on Monster Cable suing Fanny Wang over their headphones which had a passing similarity to their Beats by Dr. Dre. The lawsuit has been going on for more than a year but the process, which began by a lawsuit filed in December of 2010 by Beats Electronics, LLC and Monster Cable Products Inc. (Beats by Dr. Dre) against Fanny Wang Headphone Co, has come to an end. The suit, which we felt was extremely frivolous, was based on a design patent, not any proprietary technology, and accused Fanny Wang of infringing on US Design Patent D552,077. Last week, the lawsuit was settled by both parties. Of highest note, there was apparently no award assigned and neither of the two headphones companies paid the other any money.
